백투백신용장(Back to Back Letter of Credit)거래에서 서류매입은행의 주의의무
국제무역거래에서 신용장결제방식의 사용은 감소하는 추이를 보이고 있으나, 신용장결제방식과 관련한 분쟁은 계속해서 발생하고 있다. 본 연구는 다양한 신용장결제방식 중 그 사용이 저조한 백투백신용장과 관련한 판례를 중심으로 분석을 진행하였다. 신용장의 독립추상성이라는 특성 상 백투백신용장과 원신용장은 별개의 독립적인 거래로, 백투백신용장의 개설은행이 원신용장의 매입은행으로서 백투백신용장 상의 매입은행으로부터 서류를 매입하고 대금을 상환한 후 원신용장의 개설은행에 제시하였으나 위조한 선하증권이 사용된 점, 적법한 매입이 아니라는 판단 하에 대금지급이 거절된 판례를 중심으로 그 연구가 저조한 백투백신용장의 개념 및 절차, 그리고 적법한 매입의 기준과 매입은행의 역할 등에 대한 논의를 진행하고, 백투백신용장 하에서 서류를 매입하는 은행들의 주의사항을 고찰하였다.

Precautious Obligation of Negotiating Bank buying documents in Back to Back Letter of Credit
Although the use of letter of credit (L/C) in international trade transactions is declining, disputes related to L/C often occur. This study focused on the case related to the back to back L/C, which is not widely used in international trade. Under the nature of principle of independence of L/C, master L/C and back to back L/C are separate and also an independent transaction. The issuing bank of the back to back L/C as a negotiating bank of the master L/C purchased the documents from the negotiating bank on back to back L/C transaction, and presented the documents to the issuing bank of the master L/C. However, the issuing bank of the master L/C refused to reimburse because bill of lading was forged, and it was not a legitimate negotiation. Therefore, this study discusses the concept and procedure of the back to back L/C, the criteria of legitimate negotiation and the role of the negotiating bank, and also examines the precautions of the banks that negotiate documents under the back to back L/C.
